ALL MEMBERS ARE BOUND BY THESE RULES
- Subscription
The undersigned hereby join the Decol – Credit Net/Bureau Network . Access which is provided by Decol Debt Collections LLC , and agrees to abide by the terms and conditions of this agreement , as they may be amended from time to time by Decol .
- No Warranty Limitation of Liability
The Credit Bureau Member office acknowledges that Decol Debt Collections LLC will only be providing access to and a means of disseminating information which has been created, developed or compiled by Credit Bureau Members and third parties and that Decol Debt Collections LLC has no control over the content and quality of such information provided by a third party. As a result, Decol Debt Collections LLC makes no warranty concerning the accuracy of any information found on, or exchanged through the Network, including the Internet, and neither shall Decol Debt Collections LLC have any liability to Credit Bureau Members for any interruptions, delays, inaccuracies, errors or omissions in, or legality or appropriateness of, the information found on or exchanged through the Internet. Except as otherwise provided in writing Decol Debt Collections LLC HEREBY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE CREDIT BUREAU MEMBER OFFICE BY SIGNING THIS AGREEMENT WAIVES ANY AND ALL CLAIMS AGAINST Decol Debt Collections LLC RELATING TO THE USAGE OF MATERIAL OF INFORMATION MADE AVAILABLE THROUGH THE NETWORK AND AGREES THAT ITS USAGE OF THE NETWORK IS AT THE Credit Bureau Members OFFICES OWN RISK. IN NO EVENT SHALL Decol Debt Collections LLC BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES.
- Indemnification
The Credit Bureau Member Office shall defend, indemnify and hold Decol Debt Collections LLC harmless from any actions, claims, proceedings or liabilities arising from or relating to the Credit Bureau Member Office or Credit Bureau Member offices staff use of the Network and Services, whether authorized or unauthorized, intended or unintended, known or unknown.
- Termination
The Credit Bureau Member office is free to terminate its subscription to the Network at any time for any reason. Decol Debt Collections LLC may terminate the Credit Bureau Member office subscription for any reason on a days advance written notice to the Member office, or without notice, and at anytime if Decol Debt Collections LLC reasonably concludes that the Credit Bureau Member office has breached the terms and conditions of this Agreement or any applicable rules or if Decol Debt Collections LLC reasonably believes that the Credit Bureau Member Office has misused the Network including, without limitation and use for illegal, immoral or unethical purposes. The provisions of this Agreement and a Credit Bureau Members Office obligation to pay any sums due to Decol Debt Collections LLC hereunder shall survive any termination of this Agreement. In no event shall Decol Debt Collections LLC bear any liability to the Credit Bureau Member office for any termination of the Agreement. The Credit Bureau Member Office agrees that the information is exclusive knowledge of and distribution to the Credit Bureau Member offices and the release of the information to any other party is a breach of the terms and conditions of the Credit Bureau Member office appointment, under which this information is supplied and will result in the immediate termination of that appointment, and any punitive action considered appropriate by the Board of Directors and Committee of Management of Decol Debt Collections L.L.C.
- Miscellaneous
No provision of this Agreement may be waived or modified unless its waiver or modification is in writing and signed by Decol Debt Collections LLC and the Credit Bureau Member office. This agreement is not assignable by the Credit Bureau Member Office without the prior written consent of Decol Debt Collections LLC . Decol Debt Collections LLC may, without the Credit Bureau Member offices consent, assign this Agreement to an affiliate, joint venture, subsidiary or third party, or its rights to receive payment hereunder to a third party. Decol Debt Collections LLC and the Credit Bureau Member office each represent that it has the power and authority to enter into this Agreement and that this Agreement supersedes all prior proposals, understandings, agreements and representations between them written or oral and is binding upon each party.
- Security
The Credit Bureau Member office undertakes to maintain maximum security of it’s issued password for access to the Decol Debt Collections LLC CreditNet Network and agrees to ensure that authorised and approved management and staff by the Credit Bureau Member Office to access the network shall be required to sign and confirm that they are aware of penalties involved in the event they should breach the security of this site in anyway what so ever. No unauthorised person will be given access to, or made aware of the contents of Decol Debt Collections LLC CreditNet Network.
